1. About these Terms
These Terms of Service ("Terms") govern your access to and use of the Dai Segni application ("Service"), operated by Gavin Douglass-Cookman, a private individual residing in Berlin, Germany ("we," "us," "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You will be asked to confirm acceptance of these Terms when you create your account.
Beta programme. You are accessing Dai Segni as part of a closed, invitation-only beta. The Service is provided free of charge during the beta period. These Terms are scoped for the beta phase; a revised version will apply when the Service becomes commercially available.
2. What the Service does
Dai Segni is an AI-powered knowledge base for opera singers. You can upload audio recordings of coaching sessions; the Service transcribes the audio, analyses the coaching content using AI, and produces structured notes organised by vocal technique and repertoire. You can play back recordings, search your notes, and review your coaching history within the application.
3. Eligibility and your account
You must be at least 18 years old to use the Service.
You are responsible for maintaining the confidentiality of your account credentials. Notify us promptly at privacy@daisegni.com if you believe your account has been compromised.
During the beta, accounts are by invitation only. We may refuse or revoke access at our discretion for good cause.
4. Recording consent — your responsibility
This clause is critical. Read it carefully.
The Service processes audio recordings that may contain the voices and personal data of people other than you — most commonly your vocal coach or répétiteur.
Recording another person's non-public spoken words without their consent is a criminal offence in Germany (§ 201 StGB). By uploading a recording, you confirm that the recording was lawfully made.
Before uploading any recording, you are solely responsible for ensuring that all individuals whose voices appear in it have been informed:
- that the recording will be uploaded to a third-party cloud service;
- that it will be processed by automated transcription and AI analysis to produce coaching notes;
- that the resulting notes, transcript, and recording will be stored and accessible to you within the Service for as long as you choose to keep them;
- that they may request deletion of their personal data by contacting us at privacy@daisegni.com.
By uploading a recording, you confirm that all required consents have been obtained before upload. If you become aware of any claim arising from the recording or its upload, you agree to notify us promptly at privacy@daisegni.com and to cooperate with us in responding to that claim.
Please note that we have our own independent data controller obligations to third parties whose voices appear in your recordings; your confirmation of consent does not transfer our GDPR responsibilities to you. See our Privacy Policy for details.
5. Acceptable use
You may use the Service only for its intended purpose: managing and reviewing your own vocal coaching sessions.
You must not:
- upload recordings you do not have the right to share;
- upload content that is unlawful, harmful, defamatory, or that infringes third-party intellectual property rights;
- attempt to reverse-engineer, scrape, or extract data from the Service;
- use the Service to train, fine-tune, or develop competing AI systems;
- share your account credentials with others;
- use the Service in a way that violates any applicable law.
6. AI-generated output — important disclaimer
The notes, summaries, transcripts, and other outputs produced by the Service are generated by AI and are provided for informational and organisational purposes only.
- AI outputs may contain errors, omissions, or misinterpretations. They are not a verbatim or authoritative record of your coaching session.
- Outputs should not be treated as professional musical, pedagogical, medical, or legal advice.
- We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.
You are responsible for verifying any outputs you rely upon.
7. Beta terms — access, changes, and termination
Free access. The Service is provided free of charge during the beta period. No payment obligations arise.
Product changes. The Service is in active development. Features may be added, changed, or removed without notice during the beta.
Termination by us. We may suspend or terminate your beta access for good cause, including breach of these Terms or misuse of the Service. Where practicable, we will give you 7 days' notice and an opportunity to export your data, except in cases of suspected abuse or illegal activity, where immediate suspension may be necessary.
If we decide to end the beta programme entirely, we will give you at least 14 days' notice and an opportunity to export your data.
Termination by you. You may stop using the Service at any time. To delete your account and data, contact us at privacy@daisegni.com. You may also have a right of withdrawal under applicable consumer law — see /legal/withdrawal for details.
No compensation on termination. As the beta is free, no refunds or compensation are due.
8. Data processing
Your use of the Service involves the processing of your personal data and, where relevant, the personal data of third parties whose voice appears in uploaded recordings. Please read our Privacy Policy, which forms part of these Terms.
9. Intellectual property
All content you upload — audio, transcripts, notes — remains yours. You grant us a worldwide, royalty-free, non-exclusive licence, sublicensable solely to our technical subprocessors to the extent necessary to provide the Service to you, to process that content for as long as you retain it. This licence terminates when you delete the content or close your account.
The Service itself, including its software, design, and AI system prompts, is our property. You may not copy, modify, or distribute any part of it.
10. Limitation of liability
To the fullest extent permitted by applicable law:
- We provide the Service "as is" during the beta period.
- We are not liable for indirect, incidental, or consequential losses arising from your use of the Service, including loss of data, unless caused by our gross negligence or wilful misconduct.
- Our total aggregate liability for direct losses arising in any 12-month period shall not exceed €50.
The above limitations do not apply to:
- Liability for death or personal injury caused by our negligence;
- Liability arising from our gross negligence (grobe Fahrlässigkeit) or wilful misconduct (Vorsatz);
- Liability for breach of essential contractual duties (Kardinalpflichten); in such cases our liability is limited to typical, foreseeable losses;
- Liability under the German Product Liability Act (Produkthaftungsgesetz);
- Any mandatory statutory rights you hold under §§ 327 ff. BGB (digital products and services) or other applicable consumer protection law.
Nothing in these Terms affects any statutory rights you have as a consumer that cannot be excluded or limited by agreement.
11. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Germany.
If you are a consumer: You may bring proceedings in the courts of your country of habitual residence, and the mandatory consumer protection laws of that country apply to the extent they provide greater protection than German law. Nothing in these Terms limits your ability to bring proceedings in your local courts.
If you are not a consumer: Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
For complaints or questions, contact us at privacy@daisegni.com in the first instance. We will always try to resolve disputes informally before any formal proceedings.
12. Changes to these Terms
We may update these Terms during the beta. We will notify you by email at least 30 days before material changes take effect. If you do not wish to accept the revised Terms, you may close your account before the changes come into force by contacting us at privacy@daisegni.com. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
